    CLOCA has put forward a proposed schedule of charges to be approved at the CLOCA board of director's meeting on Tuesday, November 17.

    The CLOCA board of directors considered the comprehensive update to their fee schedules in 2015, the principle of annual inflationary increases was endorsed in order to keep the fee schedules current and to avoid future large year over year increases to the fees.

    The revised fee schedules provide for a 2% inflationary increase proposed to be effective on January 1, 2021 (the previous increase for 2020 was 2.5%).  No new fees are proposed and the structure of the fee schedules is proposed to remain unaltered.

    A revision is proposed to clarify that peer review fees may be required pursuant to CLOCA's 2014 board approved Policy and Procedural Document.  The use of a peer reviewer by CLOCA has been very rare and is focused on Lake Ontario coastal engineering issues.

    The Municipality of Clarington has posted their draft DC study for public review.  The required public meeting will be held on November 9, 2020 during the committee meeting.

    The anticipated approval date of the new by-law is December 14, 2020.

    The building industry has between now and December 14 to provide feedback, which staff will summarize and provide to council.

    A report to council will be going to committee on November 9, 2020.

    The Town of Ajax's Community Affairs and Planning Committee will be hosting a public meeting on Monday, December 7 at 7 p.m. to present and obtain public input on the municipality's proposed development charges by-law amendment and underlying background study.

    The Town of Ajax has prepared an amendment to the 2018 Development Charge Background Study in order to remove the Downtown Community Improvement Project Area (CIP) exemption provisions as directed by council on July 27, 2020 and to remove the Pickering Village Community Improvement Area (CIP) exemption provisions as directed by council on October 5, 2020.  In addition to other statutory updates, the amendment also proposes to remove the 10% mandatory statutory reduction applied to certain eligible service categories in accordance with the provisions of Bill 108, which was proclaimed into law on September 18, 2020.

    The City of Pickering will be hosting an Electronic Public Open House on Thursday, November 5, 2020, from 6:30 p.m. to 8:00 p.m. on their comprehensive zoning by-law review.

    The meeting will provide interested parties the opportunity to learn more about the discussion papers, ask questions and provide feedback.

    Ontario Dispute Adjudication for Construction Contracts (ODACC) released its 2020 Annual Report, its first annual report that includes the first 10 months since the adjudication provisions of the Construction Act came into force.

    During the 2020 fiscal year, ODACC certified 65 adjudicators, including engineers, project managers, lawyers, quantity surveyors, arbitrators, architects and an accountant.  The adjudicators set their hourly rate, between $250 and $750 per hour.  In addition, 95% of adjudicators are willing to conduct adjudications for a flat fee rate that is proportionate to the amount in dispute.  These flat fee rates range from $800 to $3,000.

    Thirty-seven of the adjudicators willing to travel to Durham Region without travel or disbursement charges.

    During ODACC's 2020 fiscal year, 32 adjudications were commenced at ODACC.  Of the 32 adjudications, 3 adjudications resulted in the rendering of a determination - 2 in Durham Region and 1 in Essex.  All three were in the residential sector.  Seven adjudications remain open, and the remaining were withdrawn on consent by the parties.

    During the 2020 fiscal year, ODACC received $3,975 (plus HST) in adjudication fees and $1,000 (plus HST) in adjudication referral fees.

    On September 24, 2020 the Local Planning Appeal Tribunal (LPAT) approved the development charges settlement brokered between DRHBA and the City of Oshawa.

    In 2019, Oshawa City Council approved a new development charges by-law, which DRHBA immediately appealed.  DRHBA then presented the City with a settlement offer, which was accepted. 

    The settlement included:

    • ·         0% of the increase applied on July 1, 2019
    • ·         50% of the increase applied on January 1, 2020
    • ·         Final 50% of the increase applied on January 1, 2021
    • ·         No indexing of development charges until January 1, 2021

    Once the by-law was put in place, the City started charging development charges with the full increase amount included.  Now that the LPAT has approved the settlement, builders who paid the full charge between July 1, 2019 and September 24, 2020 will receive a refund of the increase amount.  The City of Oshawa has begun to process these refunds.  Going forward, the appropriate amount will be charged for development charges.

    Prior to the settlement, DRHBA and its stakeholder group had reduced the increase by $2,604 per single detached home; kept the redevelopment credit at 10 years; and removed Type C Arterial roads from the development charge.

    DHRBA's executive officer, Stacey Hawkins, has been elected chair of OHBA's Executive Officers Committee.

    Stacey was certified by OHBA's governance committee, elected by her fellow EOs and confirmed by OHBA's Board of Directors and by members at the AMM.  She will serve as chair for two years.  As chair, she also becomes a non-voting member of the OHBA board of directors.
